1. Introduction and Purpose

Consultwise LLC (Software4.net) is dedicated to providing high-quality digital services, including website development, digital marketing, SEO, Salesforce consulting, and QA Testing. We aim to ensure client satisfaction and deliver measurable value. This Refund & Returns Policy outlines the conditions under which refunds may be considered for the intangible services we provide.

Due to the nature of our Services, which involve customized intellectual effort, time, and resources dedicated to specific client projects, traditional "Returns" as applicable to physical goods do not apply. Our policy focuses on the principles of fair compensation for work performed and clear guidelines for exceptions.

2. Scope of Policy

This policy applies to all fees paid for Services rendered by Consultwise LLC (Software4.net) to its Clients globally. It does not apply to any third-party costs, software licenses, advertising spending, or other expenses incurred by Consultwise on behalf of the Client, which are non-refundable by their respective providers.

3. General Principle: Fees for Services Rendered are Non-Refundable

As our Services involve the allocation of professional time, expertise, and resources, fees paid for work that has been initiated or completed are generally non-refundable. Each service phase or milestone represents a commitment to our team's labor and intellectual property development.

4. Specific Refund Scenarios

Refunds will only be considered under the following limited and specific circumstances:

  • 4.1. Project Cancellation (Client-Initiated): Before Project Commencement: If the Client formally cancels a project or specific service phase in writing before any work has commenced (i.e., before project kickoff, resource allocation, or initial discovery sessions have begun), a partial refund may be issued. This refund will be the total amount paid, less a non-refundable administrative and setup fee (typically [e.g., 10-20]% of the initial payment or a fixed amount as specified in the SOW, whichever is higher) to cover initial overheads.

  • During Project Execution: If the Client cancels a project or service phase after work has commenced, no refund will be issued for work already completed or for the current active phase. Any payments made for future unstarted phases or milestones may be partially refundable, subject to a review of incurred costs and commitments.

  • 4.2. Non-Performance by Consultwise: A refund may be considered if Consultwise demonstrably fails to deliver a core aspect of the agreed-upon Services as explicitly defined in the SOW AND fails to remedy such non-performance within a reasonable timeframe (typically [e.g., 30] business days) after receiving detailed written notification from the Client.

  • In such cases, the refund will be strictly limited to the proportional fee paid for the specific, undelivered portion of the Services directly affected by Consultwise's confirmed non-performance.

  • Important Note: Non-performance does not include:

    • Failure to achieve subjective or unquantified results (e.g., specific SEO rankings, marketing conversion rates, sales targets), as these are influenced by numerous external factors beyond Consultwise's direct control.

    • Delays caused by the Client's failure to provide timely feedback, content, or access.

    • Disagreements over subjective design elements or creative choices that the Client previously approved.

  • 4.3. Service Interruption (Directly Attributable to Consultwise): In the rare event of a prolonged and significant service interruption directly caused by Consultwise's negligence (excluding Force Majeure events or third-party platform outages), a pro-rated service credit or a partial refund for the period of un-remedied interruption may be offered, determined on a case-by-case basis.

5. Exclusions from Refunds

Refunds will generally NOT be provided for:

  • Completed Work: Fees for services, phases, or milestones that have been completed and delivered, regardless of whether the Client fully utilizes them.

  • Third-Party Costs: Expenses incurred by Consultwise on behalf of the Client (e.g., domain registrations, hosting fees, advertising budgets, software licenses, stock photos, premium plugins, Salesforce subscriptions). These are often non-refundable by the third-party vendors.

  • Subjective Dissatisfaction: Dissatisfaction with aesthetic preferences, marketing campaign performance not explicitly guaranteed, or results influenced by external factors beyond Consultwise's control.

  • Client Breach of Terms: Any termination or suspension of services due to the Client's breach of these Terms or the SOW (e.g., non-payment, failure to provide necessary access/information).

  • Project Abandonment: If a Client ceases communication or abandons a project without formal written cancellation, all payments made will be forfeited.

  • Changes in Client Business/Strategy: Client's internal business changes, market shifts, or revised strategic directions that render the initiated Services unnecessary.


6. Refund Request Process

To request a refund under the specific scenarios outlined in Section 4:
